PRIVACY POLICY - PROTECTION OF DATA

Ossa Factory, S.L., wishes to bring to the attention of the Users and customers of its Website the policy that it applies in relation to the treatment and protection of the data of a personal nature provided by those individuals who voluntarily complete the order forms to hire from Ossa Factory, S.L., any of the services offered on the Website and which involve the notification of their personal data to Ossa Factory, S.L.

1. - Identification of the Database Manager

Ossa Factory, S.L., with Spanish Fiscal Identification Code No. B17932823, entered in the Register of Companies for Girona, informs the User and customer of its Website of the existence of computerized databases containing personal data and named “Customers” and “Suppliers”, under the responsibility of Ossa Factory, S.L., with its registered office at Passeig dels Guíxols, Nos. 21-23, 17220 Sant Feliu de Guíxols, (Girona), Spain, where it stores the personal data that the Users, the Customers and the Suppliers provide to Ossa Factory, S.L. 

2. - Updating of policies

Ossa Factory, S.L., will modify, without prior notice, this privacy policy whenever this is necessary in order to adapt it to any change in legislation, statutory regulations, jurisprudence or administrative requirements, or with the aim of adapting it to the instructions issued by the Spanish Data Protection Agency, or for any legitimate purpose of Ossa Factory, S.L. Notwithstanding the above, any modification of this policy shall be published and advertised on the Website of  Ossa Factory, S.L., and in the policy itself. For all the above reasons, Ossa Factory, S.L.,advises Users to read these policies regularly so as to identify any changes that they may undergo.

3. - Purpose of the Database

Ossa Factory, S.L., does not request Users who visit its Website to provide personal data, so that the notification of personal data by Users to Ossa Factory, S.L., through its Website is only to be understood to take place when Users voluntarily use the registration form service, whether it be as a User or member, or to purchase or acquire any of the products that are sold there, given that in these cases the treatment of the data is an unavoidable and implicit part of the contractual system employed. In such cases and in those described in the following section, the entity informs the customer that the treatment of the data is undertaken for the following purposes: to promote correctly the activities of the Website, for which Users need to register as users or become members, or for the sale and delivery of the product sold. 

4. - Consent

Ossa Factory, S.L., informs Users that within this privacy policy are contained all the aspects related to the treatment of personal data that Ossa Factory, S.L., undertakes as database manager. They are thus informed that when the User registers on the Website owned by Ossa Factory, S.L., he will be giving his free, unequivocal, informed and express consent to the treatment of his personal data by Ossa Factory, S.L., for the purposes explained above, and also in order to reply to his correspondence or to send documentation to him. 
In the same way, Ossa Factory, S.L., informs Users that, if the Customer or User sends an  e-mail message or notifies Ossa Factory, S.L., of his personal data by reason of the position that he occupies in a company – whether it be as administrative director, manager, representative and/or any other position as the contact person for his company –, it shall be understood that the said notification implies the giving of his free, unequivocal, specific, informed and express consent to the treatment of his personal data by Ossa Factory, S.L., for the purposes explained above, and also in order to reply to his correspondence or to send documentation to him. 

5. - Identification of the recipients to whom Ossa Factory, S.L., foresees the possibility of passing on or giving access to data as third parties

Ossa Factory, S.L., only foresees passing on, or giving access to, data when it is required to do so in accordance with Article 11.2.c. of Spanish Structural Law No. 15/1999 concerning the Protection of Data of a Personal Nature (hereinafter referred to as Law No. 15/1999) in order to meet its obligations towards the branches of the Public Administration in those cases in which it is required to do so in accordance with the legislation in force, and with regard to each matter on each occasion and according to its merits, and to act likewise in relation to other authorities such as Judges, Public Prosecutors, the Courts of Law, the Court of National Audit, or the Ombudsman. Data will also be passed on to companies or colleagues when this is strictly necessary for the performance of the different activities of the Website.       
In the same way Ossa Factory, S.L., notifies the User that he will be informed of any other situation in which it has to pass on data whenever this is foreseen by Law No. 15/1999, and that he will also be informed in an explicit, precise and unequivocal manner of the recipients of the information, of the purpose for which the data are intended, and of the nature of the data passed on, or, if appropriate, and whenever this is foreseen by Law No. 15/1999, the User’s specific and unequivocal prior consent shall be sought 
Notwithstanding the above, Ossa Factory, S.L., informs the User and the Customer that any treatment of personal data is subject to the legislation currently in force in Spain in relation to data protection, as established by Law No. 15/1999 and its complementary enacting regulation. In this sense, Ossa Factory, S.L., is only responsible for, and only guarantees the confidentiality of, the data of a personal nature that it requests the User to provide through the Website www.ossafactory.es, bearing no responsibility of any kind in relation to any treatment and subsequent utilization of the personal data that may be undertaken by any third party providers of information society services who may access the above-mentioned data during the performance of their services or the exercise of their activity. 
“Third party providers of information society services” is to be interpreted – without limitation – as referring to those private individuals or legal entities that provide the following services: a) the transmission through a communication network of data provided by the recipients of the service; b) services of access to the network referred to; c) services of storage or stocking of data; d) the supply of material or information. In the same way, Ossa Factory, S.L., accepts no responsibility for any treatment of data that may be undertaken by third parties who establish hyperlinks with Ossa Factory, S.L., or for those who are responsible for services to which Ossa Factory, S.L., may link its visitors through the said hyperlinks.   

6. - Quality of the data

Ossa Factory, S.L., warns the User that, unless he has legally established powers of representation, no User may use the identity of another person or enter his personal data, so that the User must at all times bear in mind that he may only enter personal data that apply to his own identity and that are appropriate, relevant, up-to-date, accurate and truthful. For such purposes, the User shall be solely responsible in relation to any direct or indirect damage that may be caused to third parties or to Ossa Factory, S.L., through the use of the personal data of another person or through the use of his own personal data when they are false, erroneous, out of date, inappropriate or irrelevant. In the same way any User who uses the personal data of a third party shall be held responsible in relation to the latter person for the obligations concerning provision of information established in accordance with Article 5.4 of Law No. 15/1999 dealing with cases in which data of a personal nature have not been collected by the person concerned, and/or the consequences of not having informed the latter person of this fact.

7. - he exercise of the rights of access, opposition, rectification and cancellation with regard to data

Ossa Factory, S.L., informs the User of the possibility of exercising his rights of access, rectification, cancellation and opposition by sending a written request to Ossa Factory, S.L., at the following address: Passeig dels Guíxols, Nos. 21-23, 17220 Sant Feliu de Guíxols, (Girona), Spain, with Spanish Fiscal Identification Code No. B17932823, entered in the Register of Companies for Girona, with telephone no. +34 972 32 84 84, fax no. +34 972 32 84 85 and e-mail address info@ossafactory.es, making sure to send an accompanying document which provides clear confirmation of his identity (the photocopy of an identity document, passport, etc.).  

8. - Use of forms by Ossa Factory, S.L., to collect personal data

Ossa Factory, S.L., includes a section in its form for the collection of data, in which it indicates all the conditions for the treatment of data of a personal nature in accordance with Article 5 of Law No. 15/1999, such as the obligatory or optional character of answers to be given to the questions that are asked, the consequences of obtaining the data or of the refusal to supply them, the purpose of the collection of data, the possible passing on of data that may take place, and any consent which is given for any treatment of data of a personal nature which may occur.

9. - Security measures adopted in relation to the treatment of personal data

Ossa Factory, S.L., informs the User that, in accordance with the provisions of Law No. 15/1999 and Regulations concerning Security Measures, it has adopted the measures of a technical and organizational nature that are necessary to guarantee the security of the data of a personal nature and to avoid their alteration, loss, treatment or unauthorized access, bearing in mind the technology currently available, the nature of the data stored, and the risks to which they are exposed. In the same way Ossa Factory, S.L., guarantees to the User that it will comply with its obligation to maintain professional secrecy with regard to the personal data of the Users and its duty to preserve them.
